Essay on The Insane Mind of Edgar Allan Poe Probes
The Insane Mind of Edgar Allan Poe Probes As a short-story writer, Poe was a fascinating man of imagination. In theme, Poe places the human mind under investigation and probes insanity beneath the surface of normal existence. He was the first author in American literature to make the neurotic, the heroic figure, the protagonist, in his stories. Poes most enduring tales are those of horror, the horror coming, from the working of an irrational or criminal mind, driven to evil or insanity by a perverse irrational force which, to Poe, is an elementary impulse in man. Typically, The Cask of Amontillado, The Black Cat, and The Tell Tale Heart are three criminal stories of this kind. In these tales, Poe takes readers in the murkyâ⬠¦show more contentâ⬠¦With a fully organized plan in mind, he showed no mercy to his prey and killed him. But sometimes, this strong emotion of hatred of the characters is not simple hatred, but with an underlying mercy and guilt, and their hatred is even irrational. In The Black Cat, the narrator can not help but hate the cat, but meanwhile, still bearing an underlying feeling of guilt and mercy towards it. After each time he gets the cat hurt, he feels sorry for it, and feels himself guilty and cruel. And in The Tell-Tale Heart, the reason to kill is even less reasonable. The narrator knows very well that the old man has done no wrong to him and is actually very kind and helpful to him, sometimes just like a father. But strong feeling of hatred still emerges for just a bizarre and inconvincible reason. Though he feels his guilt, he can not stop but to kill the poor old man. In both stories, the conscience and humanity of the narrators are so feeble and pale, and so the evil hatred and cruelty can easily control the actions of the narrators. Next, there is a familiarity in all these three stories that is the stories are all told by the narrators through them confessing their heinous crimes. They all confess in a calm tone, and seem three story tellers telling their stories politely to their listeners. And the three narrators never are remorseful and feel that what they did was their fault. In The Tell Tale Heart, for example, the narrator confesses to defend

Australian Constrict Law Sole Trader
Question: Discuss about the Australian Constrict Law of Sole Trader. Answer: Assignment A Care Hire Business was carried on by Steve as a sole trader. The business was not run as a corporation. Issue Whether Tom can sue Steve for the damages sustained by him in the form of loses $ 5000 per day in profits? Law Since the relationship that existed amid Steve and Tom is commercial in nature thus the law under Competition and Consumer Act 2010 is applicable. Section 18 of the Act submits that when any person when is engaged in any trade or commerce activity then he must not undertake activities that are deceptive or misleading in nature or is likely to do the same. If any person is found to be contravention of section 18 of the Act then he is liable to pay remedies to the aggrieved party in the form of damages or termination of contract. The scope of section 18 of the Act is found in Google Inc v ACCC (2013). (Clark J 2016) In common law, if any person makes a misrepresentation (a statement of fact) and induces the other person to establish contract with him, then such contract is suffered by misrepresentation and the aggrieved party has right to terminate the contract and claim damages. (The Law HandBook 2016) Application Tom seeks information from Steve before making contract with him. He specifically submitted that he needs a truck which can carry 10 tons of cargo. Steve induces Tom by stating that the truck provided by him can carry 12 tons of cargo. He misrepresented Tom and his conduct was deceptive and misleading in nature. Thus, Tom has every right to sue Steve. Conclusion Tom can sue Steve for misrepresentation and deception and can terminate the contract and claim damages and the losses so sustained by him. Issue whether there exist a valid contract amid Pamela and Steve? Law A contract is an agreement which can be enforced by law only when it is made by the compilation of all ingredients, such as, offer, acceptance, consideration and intention. An offer is the intention of the offeror to an offeree which he expects to be confirmed by such an offeree and is called acceptance. Offer and acceptance makes an agreement. (Clark J 2016) An agreement must be supported by some benefit or gain which is exchanged amid the parties for the promises so fulfilled by them. This benefit is consideration in law. A consideration is valid only when it is made for the promises yet to be performed. There is no scope of past consideration in the contract law of Australia and is held in Roscorla v Thomas (1842). (Moles R 1998) Application Now, Pamela was performing the action of watering in the garden of Steve on her own will. There was nothing from Steve sides to compel Pamela to do the same. It was later that Steve promised Pamela that he will provide her with his act against the actions that were taken by her. But, the promise was made after the action was performed by Pamela. Thus, the consideration promised by Steve was past in nature. Conclusion Thus, Pamela cannot sue Steve and there is no contract amid the two as the consideration was past and is invalid in nature. Issues Whether Danny can sue Steve for breach of contract? Law In the law of contract, when all contract essentials are fulfilled by the offeror and the offeree then a valid contract exist amid the two. However, any valid contract can cease to exist under various situations, such as, by performance, by frustration, by agreement, by law, etc. (FindLaw 2016) One of the ground upon which a contract comes to an end is frustration. Frustration occurs when the contract ends because of some supervening event which is not in control of the parties Taylor v Caldwell(1863) (Clark J 2016). Some of the instances under which a contract is terminated on account of frustration are natural disaster, destruction of matter, war, death of the person, incapacity, etc. (Jaani 2016) Application A contract was made amid Danny and Steve wherein Steve has to provide a car to Dannay. However he was not aware while making the contract that the car was already destroyed. Thus, the subject matter of contract was not in existence when the contract was made and thus the contract was void on account of frustration. Conclusion Hence, Danny cannot sue Steve as the contract was already not valid and is terminated on the ground of frustration. Issues Whether Steve is bound by the contract made by him with Trisha? Law The two most important elements in the law of contract are offer and acceptance. An offer is the communication which is made by an offeror to an offeree under which he communicates his desires and expects an approval of the same (Gibson v Manchester City Council - CA (1978). When the offeree after understating the offer made to him accepts the same without any variations then such confirmation is called acceptance Brogden v Metropolitan Railway Co. (1877). In order to make a valid acceptance it is necessary that it must confirm the exact terms of the offer and must not bring any variation to the same. Also, an acceptance is only complete when it is communicated to an offeror (Powell v Lee (1908). (The Law Teacher 2016) However, when an acceptance is made to an offer which was never intended by an offeree then such kinds of acceptances are not valid as the same were never intended by the offeree and is held in R v Clarke(1927). Knowledge of offer is not sufficient to make a valid acceptance but the offer must intent to make an acceptance in order to make such an acceptance valid and legal in law. Application Now, Trisha has made an offer to Steve which was not accepted by him initially. Under mistake he sends his confirmation to the offer made by Trisha. But, the acceptance made by Steve was under mistake and he never intended to abide by the same. Thus, such acceptance has no valid in law and is suffered by mistake an dos thus not enforceable in law. Conclusion So Trisha cannot force Steve to bind by the contract. She declares it is haunted and that there is something queer about it (The Yellow Wall-Paper. 160). Although she acknowledges the beauty of the house and especially what surrounds it, she constantly goes back to her feeling that there is something strange about the house. It is not a symbol of security for the domestic activities, it seems like the facilitates her release, accommodating her, her writing and her thoughts, she is told to rest and sleep, she is not even allow to write. I must put this away, he hates to have me write a word(162). This shows how controlling John is over her as a husband and doctor. She is absolutely forbidden to work until she is well again. Here John seems to be more of a father than a husband, a man of the house. John acts as the dominant person in the marriage; a sign of typical middle class, family arrangement. Although the narrator feels desperate, John tells her that there is no reason for how she feels, she must dismiss those silly fantasies(166). In other words, John treats her like a child and gives her reason to doubt herself. Of course it is only nervousness(162). She decides. She tries to rest, to do as she is told, like a child, but suffers because John does not believe that she is ill. This makes her feel inadequate and unsure of her own sanity. John does not know how much I really suffer. He knows there is no reason to suffer, and that satisfies him. (162). She feels that she should be à «a good girlà » and appreciate the protective love John offers to her. à «He takes all care from me, and I feel so basely ungrateful not to value it more. He took me in his arms and called me a blessed little goose. He said I was his darling and his comfort and all he had, and that I must take care of myself for his sake, and keep well(162-167). In telling her to keep well, John expresses more doubt about her having any real illness. She tries to discuss her feelings, but this brings only a ââ¬Å¾stern reproachful lookââ¬Å"(167) and she goes back to bed. ââ¬Å¾Really dear you are better,ââ¬Å"(167). John says over and over. ââ¬Å¾Can you not trust me when I tell you so(167)ââ¬Å". John is the man of the house and also a doctor. John believes she should put complete faith in him as all children put complete faith and trust in their parents when they are small. The reproachful look, the constant reassurances, and asking for her trust only put her down, forcing her to depend on John for her survival, demeaning herself further. In addition, John enforces the inactivity that pushes her deeper into madness. John, the ââ¬Å¾lovingââ¬Å" husband-doctor, imprisons her in a room that has no escape. This room has bars on the windows and a ââ¬Å¾great immovable bedââ¬Å" which ââ¬Å¾is nailed down. ââ¬Å"(164). John has made her a prisoner in their marriage. .u49d4801551cb870811d670053237a7cc , .u49d4801551cb870811d670053237a7cc .postImageUrl , .u49d4801551cb870811d670053237a7cc .centered-text-area { min-height: 80px; position: relative; } .u49d4801551cb870811d670053237a7cc , .u49d4801551cb870811d670053237a7cc:hover , .u49d4801551cb870811d670053237a7cc:visited , .u49d4801551cb870811d670053237a7cc:active { border:0!important; } .u49d4801551cb870811d670053237a7cc .clearfix:after { content: ""; display: table; clear: both; } .u49d4801551cb870811d670053237a7cc { display: block; transition: background-color 250ms; webkit-transition: background-color 250ms; width: 100%; opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #95A5A6; } .u49d4801551cb870811d670053237a7cc:active , .u49d4801551cb870811d670053237a7cc:hover { opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #2C3E50; } .u49d4801551cb870811d670053237a7cc .centered-text-area { width: 100%; position: relative ; } .u49d4801551cb870811d670053237a7cc .ctaText { border-bottom: 0 solid #fff; color: #2980B9; font-size: 16px; font-weight: bold; margin: 0; padding: 0; text-decoration: underline; } .u49d4801551cb870811d670053237a7cc .postTitle { color: #FFFFFF; font-size: 16px; font-weight: 600; margin: 0; padding: 0; width: 100%; } .u49d4801551cb870811d670053237a7cc .ctaButton { background-color: #7F8C8D!important; color: #2980B9; border: none; border-radius: 3px; box-shadow: none; font-size: 14px; font-weight: bold; line-height: 26px; moz-border-radius: 3px; text-align: center; text-decoration: none; text-shadow: none; width: 80px; min-height: 80px; background: url(https://artscolumbia.org/wp-content/plugins/intelly-related-posts/assets/images/simple-arrow.png)no-repeat; position: absolute; right: 0; top: 0; } .u49d4801551cb870811d670053237a7cc:hover .ctaButton { background-color: #34495E!important; } .u49d4801551cb870811d670053237a7cc .centered-text { display: table; height: 80px; padding-left : 18px; top: 0; } .u49d4801551cb870811d670053237a7cc .u49d4801551cb870811d670053237a7cc-content { display: table-cell; margin: 0; padding: 0; padding-right: 108px; position: relative; vertical-align: middle; width: 100%; } .u49d4801551cb870811d670053237a7cc:after { content: ""; display: block; clear: both; } READ: Freedom Today EssayHer opinions are pushed to the side as if they are not important. Her developing insanity is a form of rebellion and a crucial turning point towards her own independence. It also shows that when an animal is caged, when it is backed into a corner, it tends to fight back. Her fight for and with the woman in the wallpaper symbolizes her fight for independence, her struggle to survive. This story also portrays the violent anger that accompanies the narratorââ¬â¢s fight to free herself. She sees the wallpaper as something that is strangling her, restraining her, and she acts out wildly. I wasnââ¬â¢t alone a bit! As soon as it was moonlight and that poor thing began to crawl and shake the pattern, I got up and ran to help her. I pulled and she shook, I shook and she pulled, and before morning we had peeled off yards of that paperââ¬Å" (171). She begins to creep and crawl within her madness. She detaches herself from the perceptions of others. In the final scene John faints and she creeps over him and says, à »Iââ¬â¢ve got out at last. And Iââ¬â¢ve pulled off most of the paper, so you canââ¬â¢t put me back! (172). This says that once independence is achieved, no ones need to rely on someone else for survival; every one backs up by herself or himself. She has achieved her independence from her submission to John as his à «blessed little goose,à » but at what price She has traded her sanity for her independence. The image in the wall-paper is not another woman, it is herself as well as all women in general and therefore all the women trapped by society. Women must be treated equally as men, for the more pressure they face the more struggle they get. They can only gain their independence by freeing themselves and working it out their minds.

Managing performance through training and development Essay
Managing performance through training and development - Essay Example The lectures indicate that there are numerous applicants received by employers for a single vacancy and work experience programmes for students and recent graduates number about 10,000 positions. Other employers are also offering industrial placements for graduates. Employers also prefer graduates with previous work experiences. Based on the above considerations, it is therefore important for me to undertake measures in order to improve my employability. I have yet to gain entry into the student and graduate training programmes or into the industrial placements for graduates. I believe that by gaining some experience and training, I can make myself stand out among the numerous applicants and thereby gain desirable employment. I understand that as early as now, as a student, I can already establish a reputation and a portfolio or profile which can later enhance my future employability. I need to first establish what I would like to be known for as a student, how wide my networks be, w hat I would like to achieve, and who will speak well of me. As a student, these are aspects of my academic life which would be formulated whether or not I would consciously seek to characterize these aspects. In effect, these elements would be the foundation for my employability. 2. Theoretical basis of the module In evaluating the various theories of the module, I noted that how I would perform in enhancing my employability is based on what I would say or do or what I would present; it is also based on the thinking and judgment of the employers I would like to impress. The theoretical basis of this module is basically the underpinning knowledge and understanding which would help me gain success in further enhancing my employability (theory). I believe that the career theory would help me first establish my personal assessment of what I would like to be, as well as settle other issues like where, when, where, who, why, and how I would like my employment chances to turn out (career t heory). The career theory also acknowledges the fact that careers go through cycles from their start-up, to their growth, then their settlement, their diversification, and their reduction (organisational cycles). There is also a right fit needed for a career to work. In order to enhance my employability, I would have to find the right fit for my skills, knowledge, goals, and interests (career fit). In applying the theories involved in enhancing my employability, I would be able to also understand that the career I would choose would have to match my requirements or needs and that my capabilities would also have to match the requirements of organizations (work adjustment theory). The vocational theory would also provide support and basis in enhancing my employability. The vocational theory is used in classifying individuals and jobs into vocational personalities (self-concept). This theory also provides tools and techniques in order to assist individuals into their distinctive identi ties and vocational personalities (vocational theory). In order to improve my employability, I would need to develop a set of skills and an identity which recruiters can use in order to easily identify my career fit and how I would fit into their own company requirements. 3. Management simulations Management simulations include the application of teamwork. Most businesses have a wide range of functions including marketing, logistics, operations, human resources, and
